These Terms and Conditions set out the basis on which Waste Disposal Greenwich provides waste collection and disposal services to domestic and commercial customers. By placing a booking, using our services, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, unless the context requires otherwise:
Customer means the individual, business, organisation or other entity requesting or using our waste collection services.
Company, we, us or our means Waste Disposal Greenwich, the service provider.
Services means any waste collection, removal, transportation, recycling or disposal services supplied by the Company to the Customer.
Premises means the property or location where the waste is to be collected or any location to which our operatives are directed by the Customer.
Booking means a confirmed request for Services made by the Customer and accepted by the Company.
The Company provides waste collection and disposal services, including the loading, transport and delivery of waste to appropriately licensed facilities. Services may include one-off clearances, regular collections, bulky waste removal and related activities as agreed at the time of booking.
All Services are subject to the type, quantity and description of waste provided by the Customer when making the Booking. The Company reserves the right to refuse, amend or cancel any Service where the waste presented differs materially from the description given or where it breaches applicable waste regulations.
3.1 Bookings may be made by telephone, email or through our online booking channels where available. The Customer must provide accurate information, including contact details, collection address, access details, description and approximate volume or weight of the waste, and any special handling requirements.
3.2 A Booking is only deemed accepted when the Company confirms the date, approximate time window, service specification and price. Confirmation may be provided verbally, by email or by written communication.
3.3 The Customer is responsible for ensuring that an authorised person is present at the Premises during the agreed collection window to direct our operatives, confirm the waste to be removed and sign any relevant documentation.
3.4 If the Customer is not present and prior arrangements have not been agreed in writing, the Company may, at its discretion, either proceed based on reasonable interpretation of the Booking or treat the visit as a failed collection. Additional charges may apply for aborted journeys or extended waiting times.
4.1 The Company primarily operates within Greenwich and surrounding areas. Provision of Services outside this service area is subject to availability and may incur additional charges.
4.2 The Customer must ensure safe and reasonable access to the Premises and to the waste to be collected. This includes ensuring that driveways, entrances, stairways and internal routes are clear and that there are no health and safety hazards.
4.3 If access is restricted or unsafe, the Company may refuse to carry out the Service in whole or in part, or may charge additional fees for time spent resolving access issues or carrying waste over longer distances or difficult routes.
5.1 The Company will only collect and dispose of waste that is permissible under applicable UK waste regulations and environmental legislation. The Customer is responsible for ensuring that all waste presented is lawful for collection and conforms to the description given at the time of Booking.
5.2 Certain waste streams are classified as hazardous or controlled and may require special handling, documentation and licensed facilities. Examples include, but are not limited to, asbestos, chemicals, solvents, oils, clinical waste, pressurised containers, gas bottles, paint, batteries and electrical items containing hazardous components.
5.3 The Customer must clearly identify any hazardous or special waste and provide all necessary information requested by the Company. The Company reserves the right to refuse the collection of any waste that it reasonably suspects to be hazardous or non-compliant, or to adjust the price to reflect additional handling and disposal costs.
5.4 The Customer warrants that all waste handed over to the Company is their property, or that they have full authority to arrange disposal. The Customer also warrants that the waste does not include stolen goods or materials obtained unlawfully.
5.5 The Company will take all reasonable steps to ensure that waste is transported and disposed of in accordance with applicable regulations and that licensed facilities are used where required. Once waste has been collected and accepted by the Company, the Company will assume responsibility as the waste carrier under relevant legislation.
6.1 Prices are generally based on the type and estimated volume or weight of waste, access conditions, labour time and any additional services agreed. Quoted prices are estimates only and may be adjusted on site once our operatives have assessed the actual waste and conditions.
6.2 Where practicable, the Company will confirm any revised price with the Customer before commencing work. If the Customer does not agree to the revised price, the Company may cancel the Service and charge a call-out or cancellation fee to cover time and travel costs.
6.3 Payment terms will be agreed at the time of Booking. Unless otherwise agreed, payment is due on completion of the Service for residential customers and within the agreed credit period for commercial customers.
6.4 Payment may be made by cash, card or bank transfer, subject to the Companys accepted methods at the time of Service. The Company reserves the right to request advance payment or a deposit, particularly for large or specialised collections.
6.5 If the Customer fails to pay on time, the Company may charge interest on the overdue amount at the statutory rate and may suspend or withdraw further Services until all outstanding sums are settled.
7.1 The Customer may cancel or amend a Booking by providing reasonable notice. Unless specified otherwise at the time of Booking, at least 24 hours notice before the agreed collection time is required to avoid a cancellation fee.
7.2 If the Customer cancels with less than 24 hours notice, or fails to provide access at the agreed time, the Company may charge a cancellation or call-out fee to cover costs incurred.
7.3 The Company aims to attend all Bookings within the agreed time window, but times are approximate and may be affected by traffic, weather, operational issues or unforeseen circumstances. The Company will use reasonable efforts to inform the Customer of any significant delays and to rearrange the Service where necessary.
7.4 The Company will not be liable for any loss, cost or inconvenience arising from delays, rescheduling or cancellation of Services due to circumstances beyond its reasonable control.
8.1 The Customer must:
a. Provide accurate information at the time of Booking.
b. Ensure safe and reasonable access to the Premises and waste.
c. Separate waste types where required and comply with any instructions given by the Company in relation to waste preparation.
d. Obtain any permissions, permits or consents necessary for access, parking or waste removal at the Premises.
e. Not request the collection of prohibited, illegal or unsafe items.
8.2 If the Customer fails to meet these obligations, the Company may refuse to complete the Service, apply additional charges, or recover from the Customer any losses or expenses reasonably incurred as a result.
9.1 The Company will exercise reasonable care and skill in providing the Services. However, the Companys liability is limited as set out in this clause.
9.2 The Company will not be liable for minor damage to paintwork, walls, floors, doors, door frames or other surfaces that is reasonably incidental to the normal execution of waste collection Services, provided our operatives act with reasonable care.
9.3 The Customer is requested to remove or adequately protect any fragile items, valuables or sensitive surfaces prior to the Service. The Company accepts no liability for damage to items that were not reasonably visible, properly disclosed, or appropriately safeguarded.
9.4 To the fullest extent permitted by law, the Company will not be liable for any indirect or consequential loss, including loss of profits, loss of business, loss of data or loss of opportunity arising from or in connection with the provision of the Services.
9.5 The Company does not exclude or limit its liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be limited or excluded.
9.6 Subject to the foregoing, the Companys total aggregate liability to the Customer in respect of any claim arising out of or in connection with the Services shall not exceed the total price paid or payable for the specific Service to which the claim relates.
10.1 Any complaint about the Services should be raised with the Company as soon as reasonably possible and, in any event, within seven days of the relevant Service. The Customer should provide full details of the issue, including any supporting evidence such as photographs or written descriptions.
10.2 The Company will investigate complaints in good faith and seek to resolve them promptly, which may include revisiting the Premises, offering remedial work where appropriate, or providing a partial refund at the Companys discretion.
10.3 If a dispute cannot be resolved through discussion, either party may pursue its legal remedies in accordance with the governing law and jurisdiction set out in these Terms and Conditions.
11.1 The Company will collect and process personal information about the Customer in order to manage Bookings, deliver Services, handle payments and communicate regarding our operations.
11.2 Personal data will be handled in accordance with applicable UK data protection laws. The Company will take reasonable steps to keep such information secure and will not share it with third parties except as necessary to perform the Services, comply with legal obligations or with the Customers consent.
12.1 All content, branding, documentation and materials produced by the Company in connection with the Services, excluding the Customers own information, remain the property of the Company or its licensors.
12.2 The Customer may not reproduce, distribute or use such materials for any purpose other than as necessary to receive the Services, unless expressly authorised in writing by the Company.
13.1 The Company may cancel a Booking or terminate the provision of Services immediately if the Customer breaches these Terms and Conditions, behaves abusively towards staff, or requests the collection of illegal or unsafe items.
13.2 Upon termination, the Customer shall pay for all Services provided up to the date of termination and any costs reasonably incurred by the Company as a result of the termination.
14.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will apply to new Bookings and to ongoing Services where legally permissible and where the Customer has been given reasonable notice.
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of the Services.
